These Terms of Service (“Terms”) govern your use of amaralise.com (the “Website”) and any purchase you make from Amara Lise (“Amara Lise”, “we”, “us”, “our”). We are a Canadian-registered company that sells and delivers products exclusively to customers located in Australia. By accessing the Website, placing an order, or using any of our services, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy. If you do not agree to these Terms, you must not use the Website or place orders.

Our online store is hosted on Shopify Inc., which provides the e-commerce platform used to process and manage orders.

Product Information, Accuracy and Availability
We take care to ensure that product descriptions, images and specifications are accurate. However, minor variations may occur due to manufacturing changes, packaging updates or display differences (for example, monitor settings). If a product you receive is significantly different from its description, you may be entitled to a remedy under the ACL.

We may change or discontinue products, adjust prices, or update packaging without prior notice. These changes will not affect orders that we have already accepted.

We are not responsible if information made available on this Website is not accurate, complete or current. Any reliance on the material on this Website is at your own risk.

SECTION 4 – MODIFICATIONS TO THE SERVICE & PRICES

Pricing, Currency, GST and Other Charges
All prices on the Website are displayed in Australian Dollars (AUD).

Amara Lise is a Canadian-registered company operating below the Australian GST registration threshold. We are not currently registered for GST in Australia and do not charge GST on orders shipped to Australia. The price you see at checkout is the final price payable to us, with no GST added by us. If our GST status changes, we will update our policies and show any applicable GST clearly at checkout.

We do not charge customs duties or import fees on orders delivered within Australia. If any government authority imposes charges, they are subject to local law, but we do not add additional duties or import fees ourselves.

We may change prices, modify or discontinue the service (or any part or content thereof) at any time without notice. Such changes will not affect orders that we have already accepted.

SECTION 5 – PRODUCTS & SERVICES

Orders and Contract Formation
Product listings on the Website are invitations to treat, not binding offers. When you place an order, you make an offer to purchase the selected products. A contract is formed only when we:

  • accept your order by sending an order confirmation email, and
  • successfully process your payment

We may decline or cancel an order before dispatch if, for example:

If you return products purchased using a discount code, the refunded amount will reflect the actual amount paid after applying the discount.

  • Orders are usually processed within 1–2 business days
  • Typical delivery time within Australia is 4–7 business days after dispatch
  • The total estimated delivery time is 5–9 business days from order to delivery

Delivery timeframes are estimates and may be affected by courier delays, peak periods, remote locations, or other external factors.

Risk of loss or damage passes to you when the order is delivered to the address you provided, or when you (or a person at your address) accept the delivery.

If a parcel is lost or damaged in transit, contact us so we can investigate with the courier and arrange an appropriate remedy, which may include a replacement or refund in line with the ACL and our Refund & Return Policy.

Taxes & GST
Amara Lise is a Canadian-registered company operating below the Australian GST registration threshold. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order), where permitted by law and without affecting your ACL rights.

Prohibited Conduct
You must not use the Website to:

  • engage in unlawful, fraudulent, misleading or harmful activity
  • upload or distribute malware, viruses or any code intended to damage or interfere with systems
  • attempt to gain unauthorised access to any accounts, systems or data
  • harvest or collect personal information about other users without consent
  • scrape, crawl or use automated tools to extract data, except where permitted by law and by us in writing
  • infringe intellectual property rights or privacy rights of others

We may suspend or restrict access to the Website if we reasonably believe you have engaged in prohibited conduct.

Disclaimer of Warranties

Except as required under the ACL or other applicable law, the Website and all products are provided “as is” and “as available” without any express or implied warranties beyond those that cannot be excluded by law.

Limitation of Liability
To the maximum extent permitted by law and without limiting your rights under the ACL:

  • we are not liable for indirect, incidental or consequential loss, including loss of profits, business interruption, or loss of data arising from use of the Website or products
  • our total liability for any claim in connection with a purchase is limited to the amount you paid for the affected product

We do not exclude liability where it would be unlawful to do so, including liability for goods that fail to comply with ACL consumer guarantees.

SECTION 14 – INDEMNIFICATION

Indemnity
You agree to indemnify and hold harmless 15699592 Canada Inc, its officers, employees and agents from any loss, damage, or expense arising from your breach of these Terms or your misuse of the Website, except where such loss is caused by our own negligence or failure to comply with our legal obligations.

SECTION 15 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be deemed severed from these Terms. Such determination will not affect the validity and enforceability of any other remaining provisions.

We may terminate or suspend your access to the Website if you violate these Terms or if we are required to do so by law.

All obligations and liabilities incurred prior to the termination date will survive the termination of this agreement for all purposes.

Governing Law and Dispute Resolution
These Terms are governed by the laws of Victoria, Australia. If a dispute arises, we encourage you to contact us first so that we can attempt to resolve the matter directly. If it cannot be resolved, you may have the right to bring a claim in a court or tribunal in Victoria, subject to any mandatory rights you may have under Australian law.

Changes to These Terms
We may update these Terms from time to time to reflect changes in law, our business, or the services we provide. The “Last Updated” date at the top of this page shows when these Terms were last revised. Updated Terms apply from the date they are published on the Website and will not affect orders already accepted. By continuing to use the Website after changes are posted, you agree to the revised Terms.

SECTION 20 – CANCELLATION & RETURNS

Returns, Refunds and Change-of-Mind
Our Refund & Return Policy forms part of these Terms and explains how cancellations, change-of-mind returns, faulty item returns and refunds are handled. Key points:

  • You may return eligible items for change-of-mind within 30 days of receiving your order, subject to conditions described in the Refund & Return Policy
  • For change-of-mind returns, you are responsible for return shipping costs
  • For items that are faulty, unsafe, misdescribed or otherwise do not comply with ACL guarantees, you may be entitled to a repair, replacement or refund and we will cover reasonable return costs

SECTION 21 – WARRANTY & PRODUCT GUARANTEE

Warranty and Product Guarantee
In addition to your rights under the ACL, we offer a voluntary 1-year product guarantee on products purchased through amaralise.com. This guarantee covers manufacturing or material defects under normal use for 12 months from the date of delivery.

The guarantee does not cover damage caused by misuse, improper care, accidents, unauthorised repairs or normal wear and tear.

If you make a claim under this guarantee, we will assess the issue and, where the guarantee applies, arrange a repair or replacement. If repair or replacement is not reasonable or possible, other remedies may be offered in line with the ACL and our internal policies.

This guarantee operates alongside, and does not replace or limit, your statutory rights under the Australian Consumer Law.
